Terms and Conditions

These terms apply when you request or book services from Clark Technical Services Ltd trading as Tayside DIY Doctor.

1. About us

Tayside DIY Doctor is a trading name of Clark Technical Services Ltd. We provide handyman services within approximately 30 miles of Perth, Scotland.

2. Estimates and quotations

The price shown during online booking as the minimum service price is the fixed minimum charge for the selected service, based on the information you provide and the normal scope of that service. It remains payable in full if the work is completed sooner than the estimated duration. It is not an hourly rate or a time-based estimate.

If the work is materially different, more complex or more extensive than described, we will explain any proposed change to the price or scope before carrying out additional chargeable work. You will not be obliged to accept the additional work.

If we propose a revised price before the appointment and you do not accept it, we will cancel the booking and refund your booking deposit in full.

You must provide accurate information and, where requested, suitable photographs of the proposed work.

3. Booking deposits

The deposit shown during booking reserves the selected appointment. It is credited against the final price of the work.

A deposit is not automatically forfeited if you cancel. We may retain an amount that reasonably reflects losses or costs caused by the cancellation, subject to your statutory rights. Any remaining amount will be refunded.

4. Your right to cancel

If you book online or by telephone, you will normally have a legal right to cancel within 14 days of entering into the contract.

If you ask us to attend or begin work during that 14-day period, you expressly request early performance of the service. If you then cancel after work has begun, you may have to pay a reasonable amount for services already supplied.

If the service has been completed in full during the cancellation period following your express request and acknowledgement, the statutory cancellation right may no longer apply.

To cancel or rearrange an appointment, contact us using the telephone number or email address above as soon as reasonably possible.

5. Access and missed appointments

You are responsible for ensuring that we can safely access the property at the agreed time and that an authorised adult is present when required.

If we cannot gain access, or cannot carry out the work because the site has not been made reasonably ready, we may treat the appointment as cancelled. We may charge an amount reflecting reasonable travel, time and other losses actually incurred. Any charge will not exceed the amount permitted by law and will not be imposed as a disproportionate penalty.

6. Materials and customer-supplied items

Unless otherwise agreed, the quoted or estimated price may not include materials.

Where you supply fixtures, fittings, furniture or other items, you are responsible for ensuring that they are suitable, complete and in usable condition. We are not responsible for defects inherent in customer-supplied products.

7. Safe and lawful work

We may refuse or stop work that we reasonably believe would be unsafe, unlawful, outside the agreed scope or unsuitable for the property.

We may recommend that specialist or regulated work is carried out by an appropriately qualified contractor.

8. Appointment changes

We will make reasonable efforts to attend at the agreed time. Occasionally an appointment may need to be changed because of illness, unsafe weather, travel disruption, delayed earlier work or circumstances outside our reasonable control.

If we need to change an appointment, we will contact you as soon as reasonably possible and offer an alternative. If no suitable alternative can be agreed, any payment for work not supplied will be refunded.

9. Payment

The deposit is payable when the booking is made. Unless otherwise agreed in writing, the remaining balance is payable when the agreed work has been completed.

Any additional work or materials must be agreed before being charged.

10. Problems with the service

Please tell us promptly if you believe there is a problem with the work. We will have a reasonable opportunity to inspect the issue and, where appropriate, put it right.

Nothing in these terms limits your statutory rights, including your right to services carried out with reasonable care and skill.

11. Liability

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

We are not responsible for losses that could not reasonably have been foreseen when the contract was made, or for business losses arising from services purchased wholly or mainly for personal use.

12. Personal information

We use the information you provide to administer enquiries, bookings, payments and services. Further information about how personal information is handled will be provided in our privacy notice.

13. Governing law

These terms are governed by Scots law. You can bring legal proceedings in the Scottish courts. If you live elsewhere in the United Kingdom, you may also have the right to bring proceedings in the courts where you live.

14. Your statutory rights

These terms do not affect any rights you have under consumer law.
